K.Govindappa S/O Thimmappa, v. The State Of Andhra Pradesh
HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.3372 of 2015 ORDER:
Heard.
Alleging inaction on the part of respondents 2 and 3 in registering crime based on the complaints of the petitioner, dated 0312-2015 and 06-12-2015, the present writ petition is filed. Learned Government Pleader has received instructions, which state that on the basis of the complaint filed by one Kuruba Anasuyamma alleging that her daughter, who is a minor, was taken away by one Siva, who is the son of the petitioner, a case in Cr.No.219 of 2014 was registered and took up investigation. The petitioner and four others, who were arrested, are stated to have been enlarged on bail by the Sessions Judge, Anantapur.
Subsequently, the petitioner's complaint, which was made to the 2nd respondent, was endorsed to the 3rd respondent by the 2nd respondent on 19-02-2015 for appropriate enquiry and based on that, after obtaining permission from the Judicial First Class Magistrate, Kalyandurg, the 3rd respondent is stated to have registered a case in Cr.No.27 of 2015 for the offence punishable under Section 506 IPC read with 34 IPC and took up investigation. During the course of investigation, the 3rd respondent examined LWs.1 to 5 and recorded their detailed statements. It is further stated that after completion of investigation, appropriate report would be filed at the earliest.
In view of the above, therefore, it is evident that not only crime is registered as FIR No.27 of 2015 on the complaint of the petitioner referred to above, but also the investigation is substantially completed. Hence, the writ petition is disposed of directing the 3rd respondent to complete the investigation in FIR No.27 of 2015 and file
appropriate final report/charge-sheet before competent jurisdictional Criminal Court at the earliest. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
