THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7627 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A1 in connection with Crime No.156 of 2022 on the file of Garidepally Police Station, Suryapet District, registered for the offences punishable under Section 307 read with 34 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case against the petitioner is that keeping in view the land disputes between him and the victim who is his co-brother, the petitioner while driving the tractor had deliberately ran over the leg of the victim.

Learned Counsel for the petitioner submits that it was an accident and keeping in view the civil disputes already existing, a police complaint is filed.

However, Accused Nos.2 to 4 were already released on bail. The petitioner/A1 is in jail since 26.07.2022 and all the material

witnesses are already examined and the Victim is treated and discharged from the hospital.

In the aforesaid circumstances, this petitioner can be granted the relief of bail subject to the following conditions: i) The petitioner/A1 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of Additional Judicial First Class Magistrate at Huzurnagar. (ii) The petitioner/A1, after release shall appear before the concerned Station House Officer, on every Monday between 10.00 A.M. to 1.00 P.M. for a period of eight weeks, for the purpose of investigation.

iv) The petitioner/A1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
