THE HON'BLE SRI JUSTICE T.AMARNATH GOUD CRIMINAL PETITION No.7708 OF 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioners/A-2 to A-4 for grant of anticipatory bail in the event of their arrest in connection with Crime No.296 of 2019 of Huzurnagar Police Station, Suryapet District, registered for the offences punishable under Sections 417, 420 & 376 (2) (n) read with 109 I.P.C.

The case of the prosecution is that on 30.10.2019 at 11.30 hours, the de facto complainant-Meesala Sailaja, aged 22 years, R/o. Huzurnagar, lodged a complaint to the police alleging that since last six years, A-1-Mellachervu Bhushibabu, who is resident of same locality, by giving impression of love and going to marry her, participated with her in sexual intercourse several times. As a result, she became pregnant twice, then A-1 convinced her and caused abortion to the knowledge of A-2 to A4. When the de facto complainant asked A-1 to marry her, he promised her that he would marry after some time. Basing on the said complaint, the police registered the above said crime for the aforesaid offences.

Heard learned counsel for the petitioners/A-2 to A-4 and the learned Additional Public Prosecutor representing the respondent/State. Perused the record.

Learned counsel for the petitioners/A-2 to A-4 would submit that the petitioners/A-2 to A-4 are innocent of the allegations and they are nothing to do with the offences and they are apprehending arrest in the hands of the police and prayed to grant bail to the petitioners/A-2 to A-4.

Learned Additional Public Prosecutor opposed the grant of the bail to the petitioners/A-2 to A-4.

The allegations levelled against the petitioners are grave in nature. The investigation is still in progress and hence, if the petitioners are granted anticipatory bail, there is every possibility of causing hindrance in the investigation and tampering the evidence. Hence, this Court is not inclined to grant anticipatory bail to the petitioners/A-2 to A-4. 7.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this petition shall stand closed.
