CRIMINAL REVISION CASE No.2756 of 2016 ORDER:
This revision is filed by the petitioner-accused against the order dated 5.3.2012 passed by the Additional Judicial Magistrate of First Class, Giddalur in C.F.R.No.6091 of 2009 filed by the 2nd respondent. It is stated that the 2nd respondent filed a complaint before the Additional Judicial First Class Magistrate, Giddalur for the offence under Section 200 Cr.P.C. The learned Magistrate referred the same to the police, basing on which, a case in Crime No.27 of 2007 was registered against the petitioner. After completion of the investigation, the police filed a final report stating that the case is in civil nature. Aggrieved by the same, the 2nd respondent filed the application in the above CFR. The learned Magistrate passed the order under revision taking cognizance for the offence under Sections 420 and 406 IPC against the petitioner-accused. Hence, the petitioner filed this revision.
Heard and perused the material available on record. Considering the facts and circumstances of the case, this Court is not inclined to interfere with the order under revision. However, the presence of the petitioner before the trial Court is dispensed with except on the dates when her presence is insisted by the trial Court. Accordingly, the Criminal Revision Case is dismissed. Consequently, miscellaneous petitions pending, if any, shall stand dismissed. ________________ RAJA ELANGO, J Date: 21.09.2016 Nn
