THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.9529 & 9551 OF 2023 COMMON ORDER:

These Criminal Petitions are filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.4, 1 & 3 respectively seeking bail in the event of their arrest in connection with Crime No.227 of 2023 on the file of Central Crime Station, EOW-III Team, registered for the offences under Sections 406, 420 and 409 r/w. 34 of IPC.

Since the petitioners in both the petitions are accused in the very same crime, both of them are heard together and disposed off by way of this common order.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the de-facto complainant is that he has invested money for the purpose of making movies. A-1 was looking after production at Hyderabad. A-2 is a Land Lord, A-3 is the Cashier and A-4 is the Accountant. It is alleged that money which was sent by the de-facto complainant for the

purpose of making movies was mis-utilized and misappropriated by the petitioners herein who were part of the Company. 5.

The disputes appears to be amongst the persons in the Company. It is stated by the learned counsel for the petitioners that all the documents pertaining to payments received, payments made and expenditure incurred were already given to the Police.

Since all the transactions are borne by record, this Court deems it appropriate to grant the relief of anticipatory bail, subject to following conditions:-

1) The petitioners/Accused Nos. 4, 1 & 3 are directed to surrender before the Deputy Commissioner of Polcie, Central Crime Station, EOW-III, on or before 24.11.2023. On such surrender, the said Station House Officer shall release the petitioners on bail, on their executing personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioners/Accused Nos. 4, 1 & 3 shall appear before the concerned Officer at 10.00 A.M everyday for a period of two weeks, for the purpose of investigation and thereafter, as and when required.

3) The petitioners/Accused Nos. 4, 1 & 3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, these Criminal Petitions are allowed.

Miscellaneous applications, if any pending in these criminal petitions, shall stand closed.
