This Writ Petition is filed seeking writ of mandamus declaring the action of the official respondents in trying to demolish the petitioner's building premises house bearing Nos.2-3-2F/6 & 2-3-2/29/6, on P.No.60 part admeasuring an extent of 323.5 sq.yds in Sy.No.296, situated at Old Village, Cherlapally, Kapra Municipality, Hyderabad at the instance of respondents 4 to 8 without following due procedure as illegal and arbitrary and for consequential directions.
Heard Sri Sunkara Naresh, learned counsel for the petitioner and Sri K.Sampath Prabhakar Reddy, learned Standing Counsel for the respondents 2 & 3.
Learned Standing Counsel for the respondents 2 & 3 submits that the Officials only visited the subject premises and asked the petitioner to produce the documents and that as on today, no action is being initiated. He further submits that before taking any action, the respondents 2 & 3 will follow due process of law.
Recording the submission of the learned Standing Counsel for the respondents 2 & 3, this Writ Petition is disposed of directing the respondents 2 & 3 not to demolish
the subject property of the petitioner, without following due process of law.
There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand dismissed.
