ORDER:

This writ petition is filed for a mandamus to set aside proceedings, dated Nil.03.2011, of respondent No.1, whereby he has suspended the petitioner's fair price shop authorization on certain alleged variations, while issuing a show cause notice, dated 01.04.2011, separately.

This Court, by order, dated 04.05.2011, in W.P.M.P.No.16790 of 2011, granted interim suspension of the impugned proceedings. At the hearing, the learned Government Pleader for Civil Supplies (TS), on instructions, submitted that the enquiry is still pending and no final order has been passed so far.

Considering the fact that the order of suspension is under suspension for more than four years and that the petitioner is being continued as the fair price shop dealer, I find it unnecessary to adjudicate on the legality or otherwise of the impugned

proceedings at this stage. Instead, it would be appropriate if respondent No.1 concludes the enquiry initiated into the allegations contained in the show-cause notice, dated 01.04.2011, passes a final order and communicates the same to the petitioner within a period of two months from the date of receipt of a copy of this order. The petitioner shall be continued as the fair price shop dealer till a final order as directed above is passed.
