THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 9488 of 2023 ORDER:
This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.1 and 3 seeking anticipatory bail in the event of their arrest in connection with Crime.No.261 of 2023 on the file of P.S Suryapet Rural, Suryapet District, registered for the offences under Sections 386, 354, 509, 342, 506, 364-A r/w 34 of Indian Penal Code and Section 27 of Arms Act, 1959.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The complaint was filed by the de facto complainant in Suryapet Rural Police Station alleging that in a transaction pertaining to Rs.30,00,000/- these petitioners and others have kidnapped the complainant and her husband and tried to extort money, pursuant to which Rs.30,00,000/- was paid in all. The same complaint was also made with Kukatpally police on 29.08.2023, which is on the very same day lodged at Suryapet Rural police.

Learned Additional Public Prosecutor would submit that earlier orders of this Court were flouted in respect of crime registered in Kukatpally Police Station. The present order will not preclude the Court from taking action in Kukatpally case. Keeping in view that both the FIR's and allegations made in subject matter of one complaint, this Court deems it appropriate to grant relief of anticipatory bail subject to the following conditions:-.
1) The petitioners/Accused nos.1 and 3 are directed to surrender before the Station House Officer, Suryapet Rural Police Station on 06.10.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused nos.1 and 3 on bail, on their executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each with two sureties for a like sum each to his satisfaction.
2) On such release, petitioners/Accused nos.1 and 3 shall appear before the concerned Station House Officer, for the purpose of investigation, as and when required.
3) The petitioners/Accused nos.1 and 3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
