HONOURABLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No.1813 of 2016 ORDER:
This Contempt Case was instituted alleging willful disobedience to the order dated 21.4.2016 passed in Writ Petition No.13280 of 2016. By the said order, the Police authorities were directed to act upon the writ petitioner's complaint dated 18.01.2016 in terms of the law laid down by the Supreme Court in Lalitha Kumari Vs. Government of Uttar Pradesh1.
The Sub-Inspector of Police, Bhemaram, Adilabad District, filed a counter-affidavit stating that he had earlier worked as the Station House Officer of Hajipur Police Station, Adilabad District, and that upon due enquiry into the petitioner's complaint, a final report was filed referring the case as 'false' before the learned Judicial First Class Magistrate, Luxettipet,vide F.R.No.7 of 2016, dated 18.4.2016. In the light of the aforestated facts, it is clear that no disobedience, much less wilful disobedience, is made out warranting exercise of contempt jurisdiction.
The Contempt Case is accordingly dismissed. No order as to costs.
