O R D E R
(Per Hon'ble Sri Justice Sanjay Kumar) This contempt case was instituted alleging disobedience to the judgment dated 23.03.2015 passed by this Court in LAAS No.599 of 2006. By the said judgment, this Court enhanced the compensation payable in respect of mango trees from Rs.1,500/- per mango tree to Rs.2,500/- per mango tree.
Heard Smt. P. Vijayalakshmi, learned counsel representing Smt. N. Shobha, learned counsel for the petitioner, and the learned Government Pleader for Appeals.
The complaint of the petitioner is that the State has not paid the compensation in terms of the aforestated enhancement. We however find that there is no direction in the judgment to the State to make the payment. Only the enhancement of compensation was effected thereby. That being so, it is for the petitioner to seek execution of the judgment and no disobedience, much less willful disobedience, is manifested in as much as no specific direction was issued by this Court.
The contempt case is accordingly dismissed. No order as to costs.
