THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12187 OF 2014 ORDER:

The petitioner has preferred the present criminal petition by invoking the provision under Section 482 of Code of Criminal Procedure (Cr.P.C.,) being aggrieved by the order, dated 01.09.2014, passed in Crl.M.P.No.2270 of 2013 by the learned IV Additional Judicial First Class Magistrate, Warangal, whereby the learned Judge directed to release the Fixed Deposit Receipts (FDRs) and Gold Jewellery on condition of the petitioner executing a bond for a sum of Rs.10,00,000/- with two sureties for likesum each and that the petitioner is directed not to encash the FDRs till the disposal of the case and not to change the shape and design of the gold jewellery. Heard.

Admittedly the petitioner is not the accused and that the petitioner is father-in-law of the accused, who is alleged to have committed offences under Sections 420, 417, 466, 468 and 406 IPC. The allegation against the accused is that he produced fake certificate showing that he is handicapped and obtained job. During investigation, the properties, which belong to the petitioner herein, were seized by the investigating agency. The learned Judge while passing orders directed to release the FDRs and the jewellery concerned on condition that the petitioner executing a bond for a sum of Rs.10,00,000/- and also directed not to encash the FDRs and not to change the shape of the gold jewellery.

Considering the facts and circumstances of the case, the criminal petition is disposed of with a direction that the FDRs and Gold jewellery shall be returned to the petitioner on condition of the petitioner executing a personal bond for a sum of Rs.10,00,000/- with one surety for the likesum to the satisfaction of the Court below and the petitioner is at liberty to encash the FDRs. The petitioner is directed

not to change the shape and design of the gold jewellery and further directed that the petitioner shall produce the same as and when required by the Court below.

With the above directions, the Criminal Petition is disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed.
