HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.26421 of 2019 ORDER:
Heard Sri Syed Mushtaq Ahmed, learned counsel for the petitioner and the learned Government Pleader for Services-I. With the consent of learned counsel for the respective parties, this Writ Petition is disposed of at the admission stage. This writ petition is filed seeking the following relief :- "......... Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring that the action of the 3rd Respondent in implicating me into the criminal proceedings without any evidence and there is no complaint of demand and acceptance of any bribe amount is contrary to Prevention of Corruption Act, 1988, arbitrary, illegal, against the principles of natural justice and unsustainable under law. Consequently set aside the impugned proceedings in Rc.No.3701/2019VIG-I dated 02.03.2019 and direct the 2nd respondent to reinstate me into Government service and to pass such other order or orders.............."
It has been contended by the petitioner that he has been working as Forest Range Officer and while he was discharging his duties, the 2nd respondent has placed him under suspension vide proceedings dt.02.03.2019 on the alleged ground that he has accepted bribe. The grievance of the petitioner is that despite lapse of six months, the respondents have not reviewed the suspension orders issued against him, in terms of G.O.Ms.No.86 dt.08.03.1994.
Therefore, learned counsel for the petitioner contends that appropriate orders be passed in this writ petition directing the respondents to review the suspension orders dt.02.03.2019
issued against the petitioner strictly in terms of G.O.Ms.No.86 dt.08.03.1994 and pass appropriate orders in accordance with law.
Learned Government Pleader appearing for the respondents had contended that the case of the petitioner would be considered in accordance with G.O.Ms.No.86 dt.08.03.1994 and appropriate orders would be passed in accordance with law. This Court, having considered the rival submissions of the learned counsel appearing for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to review the suspension orders dt.02.03.2019 issued against the petitioner, strictly in terms of G.O.Ms.No.86 dt.08.03.1994, within a period of eight weeks from the date of receipt of a copy of this order. With the above observations, this writ petition is disposed of. No order as to costs.
Pending miscellaneous petitions, if any, shall stand closed.
