HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.19552 OF 2016 ORDER:

This writ petition is filed questioning the action of the 2nd respondent in not issuing the "No Objection Certificate" to the petitioner. Heard the learned counsel for the petitioner and the learned Government Pleader for Irrigation.

It is the case of the petitioner that she is the owner of a plot bearing No.365 over an extent of 200 sq. yards situated in Sy.No.1494 of Korutla town, Karimnagar District and for getting regularization of her plot, the petitioner submitted an application to the 3rd respondent on 25.1.2016 by paying an amount of Rs.10,000/-. Thereafter the 3rd respondent directed the petitioner to submit the N.O.C from Irrigation department. Consequently, the petitioner submitted an application to the 2nd respondent requesting him to issue the N.O.C, but the 2nd respondent even though inspected the plot of the petitioner failed to issue the same to her so far. Hence, the writ petition.

The learned counsel for the petitioner submits that though the petitioner submitted an application on 23.05.2016 to the 2nd respondent putting forward the various difficulties which the petitioner is facing for not issuing the N.O.C, the 2nd respondent authorities did not issue the N.O.C to the petitioner so far. Having regard to the facts and circumstances of the case and especially in view of the fact that the innocuous prayer of the petitioner, the writ petition is disposed of directing the 2nd respondent-Executive Engineer, to consider the application of the petitioner dated 23.05.2016 for grant of N.O.C within a period of two weeks from the date of receipt of copy of this order. With the above observations, the writ petition is disposed of. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand disposed of as infructuous.
