THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.836 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-A5 under Section 438 Cr.P.C. seeking to grant anticipatory bail to him in Crime No.344 of 2015 on the file of Nandigama Police Station, Krishna District, registered for the offence punishable under Sections 302, 109 r/w 34 IPC.

Heard and perused the material available on record. It is alleged that the deceased is the younger brother the de facto complainant and on 28.11.2015, Chilaka Jebhadaiah and his son-David Raju threatened to kill the deceased and on 1.12.2015 when the deceased along with one A. Suresh, advocate went to one baddi shop at Bommidala company, the said David Raju and Chilaka Nagaraju came there and stabbed the deceased with a knife and killed him at the instigation of the petitioner and others. Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
