THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 26368 of 2019 ORDER:

This Writ Petition is filed for the following relief: "....to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in allotting double bed room houses in the Category of Journalist to the illegible persons as null and void and quash the same as unconstitutional, illegal arbitrary and violative of the Fundamental Rights of the Petitioners and consequently direct the Respondents to stop the final allotment of the double bed room house for journalists in Zaheerabad Mandal, Sangareddy District pending disposal of the writ petition....."

The petitioner asserts that the respondents have failed to consider the eligibility or otherwise of a large number of individuals in finalizing the list of beneficiaries for two-bed room houses under the quota reserved for Journalists in terms of G.O.Ms.No.10, dated 15.10.2015. It also asserts that it has brought to the notice of the Collector and other officials as to how and in what circumstances various beneficiaries who are identified by the District Authorities are ineligible for being considered under the Scheme notified in the above said G.O., but no action has been taken so far. Learned Government Pleader brings to the notice of this Court G.O.Ms.No.12 dated 26.11.2015 filed by the petitioner itself and submits that any objections with respect to the identification/eligibility or ineligibility of the individuals identified for the purpose of granting

the benefit under the above said G.O. shall be made to the District Level Officer nominated by the District Collector, who is required to conduct an enquiry and place the same before the District Level Committee.

It may be noted that in identical circumstances, this Court disposed of W.P.No.24802 of 2019 on 29.11.2019 directing the petitioners therein to approach the District Level Officer nominated by the District Collector, who shall take necessary steps by enquiring into the allegations of the petitioners, if such exercise has not already been conducted.

Inasmuch as the petitioner has made the complaints to the appropriate authority, it will be open to it to place all the necessary supporting material before the District Level Officer and satisfy him with respect to the ineligibility of the individuals against whom a complaint was made. It is needless to mention that the District Level Officer would be required to verify the material placed before him and in the event of there being any necessity, he may call for explanation from the individuals identified as beneficiaries. Subject to the above, the writ petition is disposed of. Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
