HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.40462 OF 2016 ORDER:
Heard the learned counsel for the petitioners as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.
The grievance of the petitioners, who are farmers and residents of Chinthalapalli Village, is that some non-Ayacutdars are illegally drawing water from 'Nayinipalli Tank' with oil engines from the dead storage of the tank, due to which, there is a depletion of water in the borewell meant for drinking water purpose. Petitioners and other villagers have submitted a common representation on 14.11.2016 before the 4th respondent seeking to take action against the persons responsible for such illegal drawing of water, however, till date no action has been taken. Hence, the present writ petition.
Learned AGP would submit that a suitable direction may be given to the 4th respondent to dispose of the representation filed by the petitioners, in accordance with law.
Having regard to the facts in issue, the Writ Petition is disposed of directing the 4th respondent to consider the representation filed by the petitioners and other villagers on 14.11.2016, if the same is still pending consideration, and pass appropriate orders thereon, in accordance with law, after hearing the petitioners and other aggrieved persons, if any, at the earliest.
