THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.12500 OF 2017 ORDER:

The inaction of respondent No.2, as against respondent Nos.5 to 8, who have encroached upon public road of 7 ft. land at premises bearing No.17-3-473/1/A, Behind Deccan Queen Café, Qasim Nagar Colony, Near Yazkut Mahal Talkies, Hyderabad, is questioned in this Writ Petition as being illegal and arbitrary.

Heard the learned Counsel for the petitioner and Sri Pasham Krishna Reddy, learned Standing Counsel for respondent Nos.2 to 4.

Inasmuch as the respondent - authorities to authorities are duty bound to take immediate action when a public road is occupied and ensure that illegal encroachments are removed, they shall take into consideration the representation of the petitioners, particularly, the allegation that respondent Nos.5 to 8 have encroached on to the road and making construction and, in the event, it is found that respondent Nos.5 to 8 have encroached on to the road, necessary action be taken in accordance with law.

The Writ Petition is disposed of accordingly. No costs. Miscellaneous petitions pending, if any, shall stand closed.
