The main grievance of the petitioner in the present writ petition is that respondents 2 to 4 are not conducting proper and fair investigation in Crime No.213 of 2017, registered on 02.09.2017, on the file of Wyra Police Station, Khammam District, and not filing the charge sheet before the concerned Court.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 11.12.2019, while denying the writ averments, submits that based on the complaint given by the petitioner to the fourth respondent, a case was registered in Crime No.213 of 2017 for the offences under Sections 468, 306 read with Section 34 IPC on the file of Wyra Police Station, on 02.09.2017. During the course of investigation, L.Ws.1 to 5 were examined and their statements were recorded, collected suicide note and obtained postmortem examination report. It is further submitted that investigation in the case is completed and permission has been obtained from the Assistant Commissioner of Wyra, vide proceedings C.No.33/Per/ACP-R/2019, dated 28.02.2019, to refer the case as 'False' and after serving a notice on the complainant, a final report will be filed before the concerned Court. A copy of the written instructions along with a copy of the permission proceedings dated 28.02.2019 are placed on record.

In view of the undertaking given on behalf of the official respondents in the above written instructions that after serving a notice on the complainant, a final report would be filed, no further orders need be passed in the writ petition, except directing the authorities to file the final report before the Court concerned as expeditiously as possible preferably within a period of two months from the date of receipt of a copy of this order.
