THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.4995 OF 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

On the basis of the decree, dated 16.12.2014, said to have been granted to the petitioner in O.S.No.304 of 2012 on the file of the Junior Civil Judge, Jammalamadugu, he filed representation, dated 13.08.2015, before the Tahsildar, Peddamudium Mandal, YSR Kadapa District, the 4th respondent, seeking grant of pattadar passbook and title deeds.

It is, however, evident that the suit was filed for permanent injunction and moreover the petitioner had not made any application under Form VI-A of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short, 'the Act') and the Rules framed thereunder by paying the requisite fee as required under the Act and the Rules. Hence, the mandamus as sought for by the petitioner cannot be issued to him. However, it is open to the petitioner to make an appropriate application along with the documents before the competent authority in accordance with the Act and the Rules, referred to above, and if such an application is received, the 4th respondent shall examine the same and pass appropriate orders in accordance with law, expeditiously.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
