THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.19686 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a Writ, order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 4th respondent who is the in-charge of the 3rd respondent in not referring the matter to civil court under Section 76 of the New Land Acquisition Act inspite of the petitioner representation dated 05.06.2017 in connection with the petitioners lands situated in Sy No. 27 to an extent of Ac.5.03 gts and Sy No. 30 to an extent of Ac.4.

08 gts of Polavaram Revenue Village of Kukunuru Mandal, West Godavari District and going to pay the compensation to the respondents 6 to 8 is illegal and void and opposed to Article, 14, 19, 21 and 300-A of Constitution of India and consequently to direct the respondents 1 to 4 to refer the matter to the civil court or competent authority by depositing the entire compensation amount in respect of the land in question and to pass such other order or orders in the interest of justice and to pass such other order or orders in the interest of justice."

Heard the learned counsel for the petitioners and also the learned Government Pleaders for Land Acquisition and Social Welfare for the respondents and perused the prayer in

the writ petition with supporting affidavit and other material on record.

When the matter is called, it is the submission of the learned Government Pleader for Land Acquisition that nobody appeared earlier when the enquiry was conducted on 15.06.2017.

Having regard to the above, this writ petition is disposed of, directing the petitioner to approach the authorities with written representation with supporting documents within one week from the date of receipt of a copy of this order and it is for the respondents to consider and dispose of on merits. Further grievance, if any, is left open.
