Mr.Ritesh Kumar Kanodia v. The Commissioner Of Police
THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR W RI T PETI TI ON No.2 6 4 2 2 of 2 0 1 9 O R D E R:
This writ petition is filed seeking a direction to respondents 1 to 4 not call the petitioner frequently to the police station and interfere with life and liberty of the petitioner without following due process of law.
2.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home. 3.
Learned Assistant Government Pleader for Home, on written instructions, dated 05.12.2019, submits that based on the complaint of one Mr.Vikas Chand Jain, a case is registered in Crime No.279/ 2019 under Sections 448, 380 and 420 of I.P.C on the file of Abid Road Police Station on 13.11.2019, wherein the petitioner is arrayed as Accused No.1. Learned Assistant Government Pleader further submits that the petitioner herein instead of cooperating with the investigating agency filed this writ petition with false allegations to bring pressure on the police officials and to divert them from investigating the case. A copy of written instructions dated 05.12.2019 along with a copy of complaint dated 13.11.2019 filed by one Mr.Vikas Chand Jain, a copy of F.I.R and a copy of case diary is placed on record, 4.
Without expressing any opinion on the submissions made on both sides, since a case is registered against the petitioner vide Cr.No.279 of 2019, the claim of the petitioner that the respondent authorities are frequently calling the petitioner to the
P.S and interfering with the life and liberty of the petitioner without there being a case registered against him appears to be incorrect. However, since it is submitted by the learned Assistant Government Pleader that to investigate in Cr.No.279 of 2019 the petitioner is being called to the police station and the respondents are not interfering with the life and liberty of the petitioner, no further orders need passed in the writ petition. 5.
The writ petition is accordingly closed.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
