THE HON'BLE SRI JUSTICE P.KESHAVA RAO CRIMINAL REVISION CASE NO.246 OF 2007 ORDER:

Learned counsel appearing for the petitioner informs the Court that by virtue of the memorandum of compromise entered into between the petitioner and the de facto complainant in M.O.P.No.77 of 2006 on the file of the Senior Civil Judge at Mahabubnagar, no further cause would survive in the present Criminal Revision Case.

A copy of the compromise petition filed under Order XXIII Rule 3 of the Code of Civil Procedure is placed on record. From a perusal of the said memorandum of compromise, it is evident that the petitioner herein filed Matrimonial Petition vide M.O.P.No.77 of 2006 for divorce against the de facto complainant. During the pendency of the said petition, compromise was effected between the petitioner and the de facto complainant whereby (1) the petitioner had deposited Rs.1,00,000/- in the name of the minor daughter of the de facto complainant, G. Amulya, showing the de facto complainant as the nominee, (2) house plot of 200 square yards situated at Kalwakurthy shall be transferred in the name of the minor son, G.Hareesh, under guardianship of the de facto complainant, (3) the petitioner agreed to pay Rs.3,000/- to the de facto complainant and her two minors per month for their maintenance. It is also mentioned in the memorandum of compromise that the petitioner and the de facto complainant agreed to file a copy of the memorandum of compromise before

this Court to get the Revision Case closed and, if necessary, to appear before this Court to record the compromise. Taking the above said facts into consideration, this Court is of the opinion that no further cause would survive in the present Criminal Revision case in terms of the memorandum of compromise entered into between the petitioner and the de facto complainant in M.O.P.No.77 of 2006.

Accordingly, the Criminal Revision Case is dismissed. Miscellaneous applications, if any, pending shall stand dismissed.
