ORDER

The petitioner was appointed as dealer of fair price shop No.8, Diddekunta Village, Simhadripuram Mandal, YSR District, on permanent basis, in the year 1994. His authorization was renewed from time to time and valid upto 31.03.2016. While so, a show cause notice was issued to the petitioner on 22.09.2014, for which, he submitted his explanation on 1.10.2014. Being not satisfied with the same, the 4th respondent cancelled the authorization of the petitioner. Aggrieved by the same, the petitioner preferred an appeal before the 3rd respondent and the same was dismissed vide order dated 29.07.2015. Challenging the same, the petitioner filed revision before the 2nd respondent and the same was also dismissed vide order dated 3.9.2016. Questioning the same, the petitioner filed W.P.No.35218 of 2016 and the same is pending. In the said writ petition, an interim order was passed directing the respondents to continue the petitioner. By virtue of the said interim order, the petitioner has been continuing. While so, certain irregularities were noticed in

the distribution of essential commodities by the Vigilance and Enforcement Inspector of Police on 6.5.2017 and in pursuance of the same, the impugned suspension order was passed on 30.05.2017. Challenging the same, the petitioner filed the present writ petition.

Since impugned order is an order of suspension pending enquiry, this Court is not inclined to interfere with the same. However, liberty is given to the 4th respondent to complete the enquiry initiated against the petitioner as expeditiously as possible, and not later than three months, from the date of receipt of a copy of this order. It is needless to observe that before passing the final order, the 4th respondent shall follow due process of law.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 31st July, 2017 rkk
