THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL APPEAL No.116 of 2007 JUDGMENT:
The Criminal Appeal was posted on 09.11.2017. There was no representation for the appellant. Even though the matter is posted today in the caption 'For Dismissal', none appeared. As per the material placed on record, the subject C.C.No.193 of 2002 was dismissed by the learned II Additional Chief Metropolitan Magistrate, Hyderabad, vide order, dated 19.05.2006, on the ground that there was no representation on behalf of the appellant/complainant. Though the matter was posted finally in dismissal clause, none appeared. The appellant did not show any interest to prosecute the case. Ultimately, the learned Magistrate dismissed the complaint under Section 256 Cr.P.C. and acquitted the accused. Similar is the situation in this appeal. It appears, the appellant has no interest to pursue this appeal. Further, there are no justifiable grounds to interfere with the impugned order.
Therefore, the impugned order is confirmed and the Criminal Appeal is dismissed.
