HON'BLE SMT. JUSTICE G. ANUPAMA CHAKRAVARTHY CRIMINAL PETITION No.9682 of 2o23 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Crimina-l Procedure, 1973 (for short 'Cr.P.C.') by the petitioner/ accused No.2 to quash the proceedings in C.C.No.42 1 of 2Ol7 pending on the file of the Special Judicial Magistrate of First Class (Excise), Mancherial. 2.

Heard Sri Thomas Lloyd, learned counsel for the petitioner ald Sri S.Ganesh, learned Assistant Public Prosecutor for respondent No. l-State. Perused the record. 3.

Though this petition is liled with a prayer to quash the proceedings in C.C.No.42 I of 2Ol7 , learned counsel for the petitioner has restricted his prayer for speedy disposal of the case before the trial Court.

It is the specific contention of the learned counsel for the petitioner that thc petitioner who is arrayed as accused No.2 is an old woman. It is further contended that initially, the crime was registered in the year 1992 vide Crime No.93 of iDl2 on the file of the Srirampur Police Station,

'&en a7Adilabad District and basing on the charge sheet, which was filed at a very belated stage, the C.C was numbered in the year 2Ol7 v:.de C.C.No.421 of 2017. It is further contended that since the registration of crime in the year 1992, the petitioner has been appearing before the police as well as the concerned Courts and therefore, seeks indulgence of this Court to direct the trial Court to dispose of the C.C at the earliest possible time.

Without going into the merits of the case, taking into consideration the fact that the crime was registered in the year 1992 and that C.C is pending on the file of the trial Court since 2017, this Court is of the considered view that a direction be given to the trial Court to dispose of the C.C at the earliest.

Therefore, the Special Judicial Magistrate of First Class (Excise), Mancherial, is directed to dispose of C.C.No.421 of 2Ol7 by conducting trial on da.y to day basis, preferably, within a period of four (4) months from the date of receipt of copy of the order.

Accordingly, the Crimina_l Petition is disposed of. Miscellaneous applications pending, if any, shall stand closed.
