THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.29844 OF 2016 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus to set aside the order dated 21.05.2016 in Proceedings No.GP.D/8/2016 passed by the fourth respondent.

Heard the learned counsel for the petitioner, the learned Government Pleader for Panchayat Raj and Rural Development appearing for respondent Nos.1 to 3, Sri G.Narender Reddy, the learned Standing Counsel for Gram Panchayat appearing for respondent No.4 and Sri P.Mehar Srinivasa Rao, the learned counsel appearing for respondent No.5.

At the time of arguments, the learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the writ petition with liberty to file a revision petition before the first respondent in view of Section 264 of the Andhra Pradesh Panchayat Raj Act, 1994. The learned Government Pleader also consented for the same.

In view of the submissions made by the learned counsel for both parties, this Court is not inclined to express any opinion touching the merits of the main case.

Having regard to the facts and circumstances of the case and also the submissions made by the learned counsel for both parties, the petitioner is permitted to withdraw the writ petition with liberty to file a revision petition before the first respondent challenging the
order dated 21.05.2016 in Proceedings No.GP.D/8/2016 passed by the fourth respondent.

Accordingly, the Writ Petition is dismissed as withdrawn granting the liberty as prayed for. No costs. 7.
Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
