THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40586 of 2016

ORDER

This writ petition is filed seeking to declare the action of respondents 3,4 and 5 in interfering with the right of petitioners over their agricultural land to an extent of Ac.1.22 gts in Sy.No.77A situated at Pegadapalli Village, Srirampur Mandal, Peddapally District, and registering false cases against them, as illegal and arbitrary.

It is stated in the affidavit that there were civil disputes between petitioners and respondent No.5 and a suit for partition was also pending between them. While so, respondents 3 and 4, at the instigation of respondent No.5, are interfering with the civil disputes by threatening the petitioners to foist cases against them. Hence, they filed the present writ petition.

Learned Assistant Government Pleader informed this Court that the police after due investigation registered a case against the petitioners.

Learned counsel for petitioners submits that the petitioners are ready to face the investigation, but they are being harassed by the third respondent on the basis of the complaint. 5.

Considering the facts and circumstances of the case and without going into the merits of the matter, the Writ Petition is disposed of with the following direction:

The respondents are directed not to interfere with the civil disputes, except for the purpose of investigation in the case

RE, J W.P.No.40586 of 2016 registered against the petitioners, if it is a cognizable offence, and they should follow procedure in accordance with law. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
