HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.495 OF 2017 ORDER:

This contempt case is filed alleging non-implementation of the order of this Court dated 12.07.2016 passed in W.P.M.P.No.27207 of 2016 in W.P.No.31851 of 2015.

The said writ petition was filed challenging the action of the respondents in not regularising the service of the petitioner basing on his qualifications and seniority in terms of the proceedings dated 09.01.2009 issued by the second respondent in the writ petition and also consider his case for regularization in one of the existing vacancies. This Court passed an order on 12.07.2016 in W.P.M.P.No.27207 of 2016 directing the first respondent to consider the case of the petitioner for payment of due amount of salary to him, if he is otherwise eligible and entitled to, within a period of three months from the date of receipt of a copy of that order. Thereafter, the main writ petition came up for consideration before this Court and the said writ petition was disposed of on 20.04.2017.

"Learned counsel for petitioner states that he is not prosecuting the relief in writ petition and he confines his claim to pass order on the representation made on 25.08.2015.

Having regard to the said submission, writ petition is disposed of, without entering into the controversy on merits, directing the first respondent to pass orders on the representation submitted by the petitioner on 25.08.2015, as expeditiously as possible, preferably within a period of two weeks from the date of receipt of a copy of this order." Learned counsel for the petitioner submits that when the order in the writ petition itself was not considered, he filed C.C.No.1112 of 2017, which is pending consideration.

In view of the disposal of the main writ petition and pendency of the contempt case for non-implementation of the order in the main writ petition, this contempt case cannot be entertained. The contempt case is accordingly dismissed.
