Petitioner And The State of Telangana, Rep., by the Special Chief Secretary, School Education Department, Secretariat, Hyderabad & others.
.. Respondents This court made the following :
- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.23133 of 2018 ORDER :
Heard.
2.
Petitioner is working as School Assistant (Hindi) in Zilla Parishad High School, Kongara Kalan Village, Ibrahimpatnam Mandal, Ranga Reddy District. In the transfer exercise undertaken by the School Education Department, in accordance with the Rules notified vide G.O.Ms.No.16 dated 06.06.2018 of the Telangana Teachers (Regulation of Transfers) Rules, 2018 (for short 'the Rules, 2018'), petitioner applied to consider her request for transfer. In the application against Column No.30- "Whether the HeadMaster Gr.II Gazetted/Teacher is working as NCC Officer, the web counseling application recorded as Yes." According to petitioner it was a mistake and after freezing only such errors were recorded erroneously and without the knowledge of petitioner. 3.
Having come to know of the errors, petitioner immediately submitted representation to the Gazetted Head master as well as District Educational Officer and both of them have verified the record and corrected relevant entries including the entry against column No.30. Immediately petitioner made representation to permit her to undertake editing of the entries made. Alleging that the said request is not acceded to, this writ petition is filed. 4.
During pendency of the writ petition in the transfer counselling process, petitioner is now posted to Zilla Parishad High School, (Boys), Malkajgiri, Ranga Reddy District.
- 3 - 5.
Since the transfer counselling exercise is completed and posting orders are issued, the prayer sought by the petitioner for consideration of representations cannot be granted. 6.
Be that as it may, Rule 16 of the Rules, 2018, enables preferring appeal against the decision of the District Educational Officer to Regional Joint Director of School Education. Thus, petitioner can ventilate her grievance including reflecting her name as NCC Instructor before the Regional Joint Director of School Education.
7.
Thus, leaving it open to the petitioner to work out her remedies as provided by the Rules, 2018 the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
