THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE G. SHYAM PRASAD WRIT PETITION No.28526 OF 2016 ORDER: (Per Hon'ble Sri Justice V. Ramasubramanian) The petitioner was appointed as a Village Servant on 01.08.2006. It is his grievance that without paying his salary, his services were discontinued. Therefore, he took up employment in the Andhra Pradesh State Road Transport Corporation (for short, 'the APSRTC') in the year 2010, where he is now employed continuously.

Complaining that the salary was not paid for the period from 2006 to 2010, and that he is entitled to be reinstated into service, the petitioner filed an application in O.A. No.1023 of 2016 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad (for short, 'the Tribunal'). Finding the claim to be barred by limitation, the Tribunal refused to entertain the Application, forcing the petitioner to come up with the present Writ Petition.

Heard Mr. K. Ananda Rao, learned counsel for the petitioner. The case of the petitioner would not fall either under Sub-section

(1) or under Sub-section (2) of Section 21 of the Administrative Tribunals Act, 1985. The last date of his engagement in the said service was in 2010. He approached the Tribunal in 2016 and that too after finding that several of his colleagues approached the Tribunal for similar reliefs and they succeeded up to Supreme Court. The petitioner chose to sit on the wall and watch the outcome of those proceedings before he came up with an Application before the Tribunal. Therefore, the Tribunal was right in

VRS, J & GSP, J WP No.28526/2016 dismissing the Application as barred by time. We see no justification to interfere with the said order. Hence, the Writ Petition is dismissed. As a sequel to dismissal of the Writ Petition, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand dismissed as infructuous.
