HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 39190 of 2012 Order:

This Writ Petition was filed challenging the action of the respondents in not investigating into Crime No.62 of 2012 though the same was registered on 02.12.2012.

2. When the matter is taken up for hearing, learned Government Pleader, on the basis of written instructions, submits that basing on the complaint dated 02.12.2012 a crime was registered under Sections 447, 427 read with 34 IPC and during the course of investigation five witnesses were examined and their statements were recorded. The police addressed a letter to the Tahsildar of Pullalacheruvu with a request to issue relevant records of the disputed land. The Tahsildar addressed a letter stating that the disputed land is assessed waste land. A final report was filed before the Court on 07.06.2013 referring the case as civil in nature.

3. In view of the same, the cause in the Writ Petition does not survive for consideration. The Writ Petition is, accordingly, dismissed as infructuous. There shall be no order as to costs.

4. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed.
