THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.9791 OF 2015 ORDER: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) After hearing the learned Counsel for the parties, we dispose of this Writ Petition directing the respondent Corporation not to make any attempt to recover any amount towards property tax without issuing proper demand notice as provided under the law. Merely downloading certain information from its official Website will not entitle the respondent Corporation to make any demand. The written notice demanding property tax has to be served personally upon the owner or payer of the taxable

property under the law. The communication through official website is not a substitute service of notice as the respondent corporation shall not presume that the owner/payer of the taxable property can have any computer/laptop facility in his house.

Pending miscellaneous petitions, if any, shall stand closed. There will be no order as to costs.
