THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.16464 of 2015 ORDER :
The petitioner claims to be a registered voter in Quthbullapur Assembly Constituency. He also participated in the elections to the Gram Panchayat held on 13.04.2014. The name of the petitioner was shown at Sl.No.2335 of Ward No.3 of the village. The incumbent member of Ward No.3 resigned from the office and therefore, fresh elections are proposed to be conducted to fill the vacancy. However, for conducting elections afresh voters list of Ward No.3 is now notified in May, 2015. To the surprise and shock of the petitioner, his name is not included in the voters list. The petitioner has also noticed several mistakes in drawing of the voters list which are glaring and unless they are rectified, it would gravely impact in conducting of
elections. Having noticed the illegalities in preparation of voters list, on 25.05.2015 the petitioner submitted representations bringing to the notice of various authorities including the District Panchayat Officer (3rd respondent herein) who is the competent authority to prepare the voters list. But so far no orders are passed. The petitioner apprehends that the notification for conducting of elections of Ward member to Ward No.3 of Qutubullapur is likely to be issued shortly and if the notification is issued, the petitioner cannot agitate the grievance, until the election process is completed and in such event great prejudice would be caused.

Since the representation submitted by the petitioner is pending without expressing any opinion on merits, the Writ Petition is disposed of directing the 3rd respondent, to consider the objections filed by the petitioner on 25.05.2015, if such objections were received by him and are not disposed of so far, within a period of two (2) weeks from the date of receipt of a copy of this order and at any rate before finalisation of the voters list and issuance of notification for conducting of elections.
3. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
