HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.31904 OF 2017 ORDER:

The case of the petitioner is that he was appointed as SubEngineer on 27-12-1999 and thereafter appointed by transfer as Assistant Engineer on 04-01-2005 in the 1st respondentcompany and dispute arose when the respondents granted Seniority to Assistant Engineer joined on contract basis. The same was challenged in WP.No.29418 of 2010, which was dismissed. Against the same, W.A.Nos 1104 of 2011 and Batch was filed. The said appeal was allowed on 17-09-2013 and S.L.P. filed against the same and thereafter review petition in WAMP.No.3641 of 2013 and batch were filed and they were dismissed. But inspite of the same, seniority of the petitioner is not fixed. However, the petitioner made a representation dated 02-02-2017 to the 2nd respondent for fixing the seniority. The 2nd respondent addressed a letter to the 1st respondent on 01-04-2010. But no action has been taken by the 1st respondent. Aggrieved by the same, the present writ petition is filed.

Learned counsel for the petitioner submits that when once it is held by this Court and confirmed by the Supreme Court, services rendered by the contract employees cannot be counted for the purpose of seniority and the seniority list prepared basing on the same has to be revised. Heard learned counsel for the respondents.

In view of the above facts and circumstances of the case, the 1st respondent is directed to take appropriate action on the letter addressed by the 2nd respondent on 01-04-2010 within a period of eight weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
