This Writ Petition is filed for a Mandamus to declare the action of respondent No.3, in not receiving the petitioners' applications for grant of licenses for carrying on the fruits business as commission agents within the notified area of the Agricultural Marketing Committee, Gaddiannaram,

as illegal and arbitrary and for a consequential direction to respondent No.3 to receive the petitioners' applications and consider the same in accordance with the Andhra Pradesh (Agricultural Produce & Live Stock) Markets Act, 1966.

After arguing the case, Mr.K.K.Chakravarthy, learned Counsel for the petitioners, upon instructions from his clients, fairly submitted that the plea of the respondents that, at present, no space is available for considering the request of the petitioners is correct.

Accordingly, he has requested the Court to close the Writ Petition with liberty to the petitioners to approach respondent No.3 as and when additional space is created for allotment to the traders.

Subject to the liberty given to the petitioners as requested above, the Writ Petition is closed. As a sequel to closure of the Writ Petition, WPMP.No.42823 of 2012, filed by the petitioners for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 3rd September, 2015 LUR
