HONOURABLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No.8046 of 2016 Order:

This criminal petition is filed under Section 482 Cr.P.C by the petitioners-respondents 1 to 8 seeking to quash the proceedings in D.V.C.No.27 of 2016 on the file of the XIV Metropolitan Magistrate, Kukatpally, Cyberabad, for the offences under Sections 17(1) and (2), 18(a), (b), (d), (e), (f) and (g), 19(1)(a) to (f), 19(2), (3) and (5) to (8), 20(c) and (d), 21, 22 and 23 of the Protection of Women from Domestic Violence Act, 2005.

2. Heard the learned counsel for the petitioners-respondents 1 to 8 and the learned Public Prosecutor and perused the material available on record.

3. On a perusal of the charge sheet, this Court is of the view that truth or otherwise of the allegations made against the petitioners can be decided only after due trial. Hence, this Court is not inclined to interfere with the proceedings against the petitioners.

4. In any event, considering the nature of the allegations against the petitioners 2 to 8-respondents 2 to 8 and the petitioners 3, 4, 6 and 8-respondents 3, 4, 7 and 8 being ladies, presence of the petitioners 2 to 8-respondents 2 to 8 before the trial Court is dispensed with except on the dates of framing of charges, examination under Section 313 Cr.P.C. and pronouncement of the judgment.

5. Considering the nature of allegations against petitioner No.1respondent No.1, the criminal petition is dismissed as far as petitioner No.1-respondent No.1 is concerned.

6. Accordingly, the criminal petition is disposed of. The learned XIX Metropolitan Magistrate, Kukatpally, Cyberabad is directed to dispose of D.V.C.No.27 of 2016 as expeditiously as possible

preferably within a period of six months from today without insisting upon the presence of the petitioners 2 to 8-respondents 2 to 8 on each date of hearing. Consequently, the miscellaneous petitions, if any, pending in this criminal petition shall stand closed. ____________________ M.S.K. JAISWAL, J.
