O R D E R

The case of the petitioners is that the 1st petitioner purchased the subject property in the year 1956 for a valuable sale consideration and since then has been in possession and enjoyment. Based on the complaint of respondents 5 and 6 that petitioners have encroached the subject land, the 3rd respondent, vide proceedings in LTR. Case No.1/2014/TKP dated 24.08.2015 directed the 4th respondent to remove the encroachment. Aggrieved thereby, petitioners filed appeal before the 2nd respondent in C.M.A.No.54 of 2015 and the same was also dismissed vide order dated 5.5.2018. Petitioners preferred revision before the 1st respondent on 23.06.2018, along with a stay petition. The grievance of the petitioners is that the 1st respondent is not disposing of the revision and in the meanwhile, the 4th respondent is taking steps to take possession of the subject property. Hence the writ petition.

Heard the learned counsel for the petitioners, learned Assistant Government Pleader for Social Welfare for respondents 1 to 3 and learned Assistant Government Pleader for Revenue for respondent no.4. Since the revision filed by the petitioners on 23.06.2018, is pending consideration, without expressing any opinion on merits, writ petition is disposed of directing the 1st respondent to dispose of the revision in accordance with law, after issuing notice and giving opportunity of hearing, to all the effected parties, including the petitioners.

Till the disposal of revision by 1st respondent, status quo obtaining on today with regard to possession over the subject property shall be maintained.
