HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.1994 of 2015 ORDER:

This revision is preferred challenging the order dated 25-08-2015 made in Crl.M.P.No.1999 of 2015 in C.C. No.100 of 2012 by the XV Additional Chief Metropolitan Magistrate-cum-Special Court of the trial of Video Piracy Cases, Hyderabad at Nampally, wherein the learned Magistrate dismissed the petition filed by the petitioner invoking the provisions under Section 70(2) of Cr.P.C seeking to recall N.B.Ws. The learned counsel for the petitioner submitted before this Court that petitioner is ready to face the trial and he will not flee from the hands of justice. Having heard the learned counsel on either side and perused the material available on record, this Court is of the view that the revision can be disposed of with the following directions :

The petitioner/accused is directed to appear before the Court concerned and file a petition afresh to recall the warrant issued against him and on such filing of a petition, the trial Court is directed to recall the warrant on the same day on his execution of bond for a sum of Rs.10,000/- (Rupees ten thousand only) with

one surety for a like sum and further the petitioner is directed to appear before the trial Court regularly. Accordingly, the Criminal Revision Case is disposed of.

Consequently, the Miscellaneous Petitions pending, if any, in this revision shall stand closed.
