The present writ petition is filed to declare the action of the third respondent in calling the petitioners to the police station without there being any crime and making their guardians to come to the police station during odd hours and making them to sit in the police station, as illegal, arbitrary and unjust.

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 02.12.2019, which is placed on record of this Court, submits that basing on the complaint of one Chandramouli Surepalli, a case was registered in Crime No.28 of 2019 for the offence under Section 379 IPC on the file of Kondapur Police Station, on 29.05.2019. Another case is also registered in Crime No.31 of 2019 before the same police on 27.06.2019 basing on the complaint of one Subrahmanyam. Learned AGP further submits that, while the investigation was going on, Itkyala Police arrested Juveniles Vadde Sudhakar, Vadde Chinna, the petitioners herein, and others, in Crime 86 of 2019 on the file of Itikyala Police Station, wherein they confessed about the offences committed within the jurisdiction of Kodandapur Polcie Station limits, pertaining to Crime Nos.28 and 31 of 2019.

Based on the said written instructions, it is stated that knowing about the arrest of the Juveniles by the Itkyala police authorities, the Station House Officer, Kondandapur, filed a requisition before the Juvenile

Justice Board, Mahabubnagar, on 15.07.2019, for custody of the petitioners in Crime Nos.28 and 31 of 2019. In the meanwhile, the petitioners were released by the Juvenile Justice Board in Crime No.86 of 2019 and as such, the petitioners were not arrested in Crime Nos.28 and 31 of 2019, though the two cases are under investigation. By the said instructions, learned AGP denied the allegations made by the petitioners that the police authorities are calling them to the police station without there being any crime, in view of the above two crimes, viz., Crime Nos.28 and 31 of 2019 of Kodandapur Police Station having been registered against the accused. It is also stated that the third respondent never called the guardians of the petitioners to the police station, nor made them sit in the police station.

Recording the above submissions made by the learned Assistant Government Pleader on behalf of the third respondent, this Court is of the view that no further orders are required to be passed in the writ petition. 6.

The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
