HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.27002 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of both the parties.

This writ petition is filed seeking the following relief :- " ..... to issue a writ of Mandamus or any other appropriate writ, order or direction to declare the inaction of the respondents in dodging to settle the matter providing all the death benefits / pension and compassionate appointment to the petitioners in the place of Late Ramesh S/ o Seetharamulu as per the law whereas they made representation dated 25/ 6/ 2019 but so far the respondents are not considering in positive manner which the inaction is illegal, arbitrary and unjustice depriving the natural justice, consequently direct the respondents to provide all death benefits including compassionate appointment to the petitioners as per the representation dated 25/ 6/ 2019.

Further, direct the respondents not to entertain any other family members or third party claims except the petitioners for the death benefits of late Ramesh S/ o Seetharamulu until the pending of writ petition......" .

Heard Mr.G.L.Narasimha Rao, the learned counsel for the petitioners and the learned Standing Counsel for the respondents. It has been contended by the learned counsel for the petitioners that one Y.Ramesh, who is the husband of the 1st petitioner and the father of the 2nd petitioner, died on 22.05.2019. Though the 1st petitioner was living separately from her deceased husband during his life time, the 2nd petitioner is the son born out of the wedlock of the 1st petitioner with the deceased employee. The 1st petitioner has submitted a representation to the respondents on 25.06.2019 requesting to consider the case of the 2nd petitioner for

appointment on compassionate grounds and settle the terminal benefits of the deceased employee. But, so far, the respondents have not passed any orders on the said representation nor considered the case of the 2nd petitioner for appointment on compassionate grounds.

Learned counsel for the petitioner submits that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the 1st petitioner on 25.06.2019 and pass appropriate orders in accordance with law. Learned Standing Counsel appearing for the respondents has contended that since the representation of the 1st petitioner is pending, the respondents would consider the same and pass appropriate orders in accordance with law.

This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the 1st petitioner on 25.06.2019 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
