THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.22936 OF 2017 ORDER:

This writ petition is filed seeking to issue a writ of mandamus to declare the inaction of the 1st respondent in issuing Annexure-III, under Section 22(A)(1)(C) of the Registration Act, including the land of the petitioner of an extent of Acs.1.50 cents, in Sy.No.186/ 6, situated at Ambur Village, Varadaiahpalem Mandal, Chittoor District as the same belonging to Kumaraswamy Gurukula Manyam, as illegal and arbitrary, and consequently, prohibiting the said land from further alienations without specific permission from the competent authority. It is the case of the petitioner that the land of an extent of Acs.1.50 cents in Sy.No.186/ 6 of Ambur Village, is a patta land originally standing in the name of petitioner's husband. After the death of her husband, the petitioner is cultivating the said land. While so, the 1st respondent - Assistant Commissioner of Endowments, Chittoor District, issued Annexure-III under Section 22(A)(1)(C) to the Sub-Registrar, Satyavedu, showing Sri Kumara Swamy Gurukula Manyam as the owner of the subject land.

Immediately, the petitioner submitted a representation through her grand-son to the 1st respondent. But, no action is taken by the 1st respondent. Therefore, the petitioner issued legal notice, dated 06.04.2017, to the respondents. But, the respondents have not taken any action so far. Hence, this writ petition. Heard and perused the material available on record. Considering the circumstances of the case and the grievance of the petitioner, without going into the merits, this Court is inclined to pass the following order:

The respondents are directed to consider representation, dated 19.12.2016, submitted by the petitioner through her grand-son, and pass appropriate orders in accordance with law, as expeditiously as possibly, preferably, within a period of eight (8) weeks from the date of receipt of a copy of this order.

No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
