Heard learned Counsel appearing for the petitioner and the learned Government Pleader for respondents No.1 to 3 and Smt.K.Lalitha, learned Counsel for R.4.
According to the petitioner, by completely giving go-bye to a condition in the tender-cum-auction notification, which stipulated the production of GST Number, the respondent-authorities are allotting the shops belonging to the R.4-institution. According to the petitioner, he submitted a representation to the Commissioner of Endowments-R.2 herein on 02.07.2018 complaining about the said irregularity said to have been committed by the respondent No.4 herein. In the said representation, the petitioner herein also stated that he was prevented from participating in the public auction.
During the course of hearing, it is submitted by the learned Standing Counsel appearing for R.4 that on 27.06.2018 proposals have been submitted to the Commissioner's Office for approval of the above tenders and the said proposal is pending. Since the representation, dated 02.07.2018, according to the petitioner, is pending consideration before the Commissioner of Endowments so also the proposals already forwarded by R.4 to the Commissioner, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the 2nd respondent to verify the representation, dated 02.07.2018, said to have been submitted by the petitioner herein, and take appropriate action, strictly in accordance with law, within a period of four weeks from the date of
receipt of a copy of this order. Till an order is passed on the representation, dated 02.07.2018, the decision on the proposals sent by R.4 on 25.06.2018 in respect of the subject shops shall be deferred.
Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed. There shall be no order as to costs.
