HON'BLE SRI JUSTICE S.V.BHATT W.P.No.44832 OF 2016 ORDER:

Heard Mr.Ch.Ravinder for petitioner, the Assistant Government Pleader for Municipal Administration for respondent No.1, the Assistant Government Pleader for Roads and Buildings for respondents 2, 4 and 5 and Sri N.Praveen Kumar, Standing Counsel for respondent No.3.

The petitioner prays for Mandamus declaring the action of respondents in trying to demolish petitioner's premises bearing No.16-34 situated on Jammikunta Main Road, Huzurabad, Karimnagar District, without recourse to law or paying compensation to petitioner, as illegal, arbitrary and unconstitutional.

Mr.Ch.Ravinder, to demonstrate petitioner's right, title and also existence of pucca building, relies upon annexures P-1 to P-14 filed along with writ petition and prays that if the marked portion is demolished without recourse to law, the petitioner will suffer irreparable loss, hardship and injury.

The standing counsel representing respondent No.3, on instructions, submits that the steps undertaken as on date is marking of portion likely to be affected by the widening of road into a four line road. As and when the demolition or dispossession is carried out, he submits that respondent No.3 will follow the procedure

stipulated by law, for either dispossessing or demolishing the petitioner's premises.

This Court accepts the statement made on behalf of 3rd respondent and likewise for respondents 1, 2, 4 and 5. Accordingly, the respondents are directed not to dispossess the petitioner or demolish the structure at subject premises, except in accordance with law.

The writ petition is, accordingly, disposed of. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any pending, also stand disposed of.
