HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.1908 of 2015 ORDER:

This revision is filed against the order, dated 1308-2015 passed by the Judicial First Class Magistrate, Chittoor, Chittoor District in Crl. M.P.No.558 of 2015 in S.T.C. No.55 of 2013, wherein and whereby the trial Court dismissed the petition filed by the petitioner invoking the provisions under Section 91 of Cr.P.C. seeking to summon the Manager, Sapthagiri Grameena Bank, Kuppam Branch to produce the petition schedule documents.

The trial Court has rightly dismissed the petition on the ground that always presumption is in favour of the petitioner, who is complainant and it is for the accused to rebut the same. Hence, the order passed by the trial Court is in accordance with law and there is no need to interfere with the order impugned. Accordingly, the Criminal Revision Case is dismissed.
