THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.28488 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of the second respondent in permitting the petitioner for shifting of his saw mill, as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Forests.

The learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the writ petition with liberty to file a fresh application before the second respondent for shifting of his saw mill.

Permission is granted.

Hence, the Writ Petition is dismissed as withdrawn by granting the liberty as prayed for. No costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
