THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7667 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A2 seeking bail in the event of his arrest in connection with Crime No.223 of 2022 on the file of Bhongir Rural Police Station, Rachakonda District, registered for the offences punishable under Sections 419, 420, 467, 447 read with 120 of the Indian Penal Code. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The present complaint was filed on 28.06.2022 alleging that the land of the uncle of the defacto complainant was given on lease to Accused No.1. However, A1 transferred by registering sale deed in favour of this petitioner on 27.02.2008. The present complaint is filed after 14 years alleging that this petitioner had committed the offence of cheating and fabrication of documents.

Since the complaint pertains to the sale deed which was executed on 27.02.2008, this petitioner who is the purchaser can be granted the relief of Anticipatory Bail in the event of his arrest, subject to the following conditions:

1) The petitioner/A2 is directed to surrender before the Station House Officer, Bhongir Rural Police Station, Rachakonda, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release

the petitioner/A2 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A2 shall appear before the concerned Station House Officer on every Monday between 10.00 A.M to 1.00 P.M for a period of four weeks, for the purpose of investigation.

3) The petitioner/A2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
