THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 26515 OF 2019 O R D E R :

This writ petition is filed challenging the action of respondents 3 and 4 in seizing the vehicle of the petitioner bearing No.AP 24 TB 4352, Tata Goods Carriage, as illegal and arbitrary.

Learned Counsel for the petitioner submits that the lis in the writ petition is squarely covered by order dt.20.11.2019 passed in WP.No.25327 of 2019, and the same is not disputed by learned Assistant Government Pleader for Civil Supplies. In view of the same and for the reasons alike, this writ petition is also disposed of directing the respondents to release the vehicle of the petitioner bearing No.AP 24 TB 4352, on condition of the petitioner furnishing personal bond and further an undertaking to produce the vehicle before the authorities concerned as and when required. It is made clear that if the petitioner do not produce the vehicle before the authorities concerned as and when required, the respondents shall be at liberty to initiate criminal proceedings against the petitioner and take appropriate action in accordance with law. This order will continue to be in force till conclusion of enquiry under Section 6-

A of the Essential Commodities Act and further the 2nd respondent is directed to conclude the 6-A enquiry as expeditiously as possible. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
