HON'BLE SRI JUSTICE A.RAJASHEKER REDDY AND HON'BLE SRI JUSTICE M.LAXMAN FCA No.240 AND 258 OF 2019 ORDER: (per Justice A.Rajasheker Reddy) FCA Nos.240 & 258 OF 2019:

This appeal is filed against the Common Order and Decree dt.21.09.2019 in FCOP No.799 of 2013 and 418 of 2016, wherein and whereby the Court below allowed FCOP.No.799 of 2013 filed by the wife for restitution of conjugal rights and dismissed FCOP.No.418 of 2016 filed by the husband for divorce.

Heard Dr.J.Vijayalaxmi, learned counsel for the appellant-husband in FCA No.258 of 2019 and Sri Kadiyam Neelakanteswara Rao, learned counsel for the respondent-wife.

Because of the efforts made by both the counsel, both the parties, the child, and also this Court, the husband and wife came together.

The E-mail dt.09.03.2022 addressed by the appellant-husband to his counsel is produced before this Court which reads as follows;

"Respected Vijayalakshmi garu, I travelled back to Germany on February 17th and currently my wife and son are living with my parents in Hyderabad. So far things are going in a smooth direction without any disturbances.

I have initiated the process of bringing my wife and son to Germany in this year itself. In this regard Visa slots were booked for both of them at the German Embassy in Chennai on 31st March, 2022. Right necessary documents were getting prepared for a family reunion visa.

Happy to answer any questions you have."

It is also stated by the learned counsel for respondent that the respondent-wife is living with the parents of the appellant-husband as agreed by them, on the earlier occasion, before this Court and that everything is peaceful. It is also stated by both the counsel on instructions that the appeal can be closed.

We appreciate the efforts made by either parties as well as both the counsel and this should the approach of all the counsel in the family matters.

By recording the aforesaid submissions made by both the counsel, these appeals are closed with liberty to seek for re-opening, if circumstances warrant. No order as to costs.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
