THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NOS.9578 & 9591 OF 2023 COMMON ORDER:

These Criminal Petitions are filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.1 and respectively in Crime.No.82 of 2023 on the file of Julurpadu Police Station, Bhadradri Kothaguem District, registered for the offence under Section 8(c) r/w. 20 (b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Since the petitioners in both the petitions are accused Nos.1 and 2 respectively in the very same crime, both the petitions are heard together and disposed off by this common order.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondentState and perused the record.

The case of the prosecution is that on 24.07.2023, vehicle was stopped and A-2/Driver tried to run away from the Police. He was chased and apprehended. A-1 was sitting in the case. In the said car, the Police found 28 kgs of ganja. Accordingly, the procedure was followed and the petitioners were remanded to judicial custody. 5.

Keeping in view that A-1 is a woman and most part of the investigation is complete, this Court deems it appropriate to grant the relief o regular bail to the petitioners, subject to following conditions: i) The petitioner/Accused Nos.1 and 2 shall execute personal bond for a sum of Rs.50,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of Special Sessions Judge for NDPS Cases-Cum-I Additional Sessions Judge, Kothagudem. As far as A-1 is concerned, she shall execute one local surety and other from her native place.

ii) The petitioners/Accused Nos.1 and 2 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday and Wednesday for a period of eight weeks and

thereafter, as and when required for the purpose of investigation.

iii) The petitioners/Accused Nos.1 and 2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, these Criminal Petitions are allowed. Miscellaneous applications, pending if any, shall stand closed.
