HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13709 OF 2016 ORDER:

This writ petition is filed by the petitioner challenging the orders passed by the 2nd respondent in proceedings No.A3/707/1/2015-16 dated 21.12.2015 confirming the orders passed by the 3rd respondent in orders No.E/938/2014, dated 08.06.2015 directing the petitioner to pay maintenance of Rs.7,000/- to the 4th respondent.

W.P.M.P No.6114 of 2017 is filed seeking to set aside the impugned order of the 2nd respondent dated 21.12.2015, whereby an amount of Rs.7,000/- is granted to the 4th respondent by way of maintenance payable by the petitioner. Now both counsel submit that the matter has been settled between petitioner and the 4th respondent, who are son and mother respectively and they have also filed compromise memo along with petition, wherein the petitioner assured to look after his mother i.e., 4th respondent and give no room for any complaints against her maintenance.

Recording the compromise and taking on record affidavit filed in support of the petition, the impugned order dated 21.12.2015 is set aside and the writ petition is allowed. However, the 4th respondent is at liberty to make a fresh application before this Court to revive the impugned order, in case the petitioner neglects to maintain her, as assured in the affidavit filed in support of this petition.

There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
